Pseudomonas syringae; Registration Review Final Decision; Notice 
of Availability
 
SUMMARY: This notice announces the availability of EPA's final 
registration review decision for the pesticide Pseudomonas syringae, 
case 6007. Registration review is EPA's periodic review of pesticide 
registrations to ensure that each pesticide continues to satisfy the 
statutory standard for registration, that is, that the pesticide can 
perform its intended function without causing unreasonable adverse 
effects on human health or the environment. Through this program, EPA 
is ensuring that each pesticide's registration is based on current 
scientific and other knowledge, including its effects on human health 
and the environment.

Dimethyldithiocarbamate Salts; Amendment to Ziram and Ferbam
Reregistration Eligibility Decisions

SUMMARY: This notice announces EPA's decision to amend the 2003 and
2005 Reregistration Eligibility Decisions (RED) documents for the
antimicrobial pesticides Ziram and Ferbam (Reregistration Case 2180).
EPA conducted a reassessment of the Ziram and Ferbam REDs upon learning
that the salts Potassium Dimethyldithiocarbamate and Sodium
Dimethyldithiocarbamate were not evaluated at the same time as the rest
of case 2180. The Agency has conducted a risk assessment and issued a
RED addendum for the Dimethyldithiocarbamate Salts, which were
inadvertently not included in the 2003 and 2005 Reregistration
Eligibility Decision documents for Ziram and Ferbam. This notice opens
an additional 60-day public comment period for Dimethyldithiocarbamate
Salts because a previous comment period for the Risk Assessment portion
of this addendum was restricted to registrants only.

Malathion Registration Review Docket; Reopening of Comment Period
 
SUMMARY: EPA issued a notice in the Federal Register of June 24, 2009, 
concerning the availability of multiple registration review dockets for 
public comment, including malathion. This document reopens the comment 
period for the malathion registration review docket, which closed on 
August 24, 2009, until October 5, 2009.
 
DATES: Comments, identified by docket identification (ID) number EPA-

Registration Review; Glyphosate Docket Opened for Review and 
Comment
 
SUMMARY: EPA has established a registration review docket for the 
pesticide listed in the table in Unit III.A. With this document, EPA is 
opening the public comment period for this registration review. 
Registration review is EPA's periodic review of pesticide registrations 
to ensure that each pesticide continues to satisfy the statutory 
standard for registration, that is, the pesticide can perform its 
intended function without unreasonable adverse effects on human health 
or the environment. Registration review dockets contain information 
that will assist the public in understanding the types of information 
and issues that the Agency may consider during the course of 
registration reviews. Through this program, EPA is ensuring that each 
pesticide's registration is based on current scientific and other 
knowledge, including its effects on human health and the environment. 
Previously, docket number EPA-HQ-OPP-2007-0147 was announced as open 
for review and comment on June 24, 2009, on the registration review 
case of glyphosate. However, this was an inaccurate docket number 
reference for this pesticide chemical case. Therefore, the correct 
docket number for the registration review case of glyphosate is EPA-HQ-
OPP-2009-0361.

Malathion Revised Reregistration Eligibility Decision
SUMMARY: This notice announces EPA's decision to modify certain risk 
mitigation measures that were specified in the 2006 Reregistration 
Eligibility Decision (RED) for the pesticide malathion. EPA conducted 
this reassessment of the malathion RED in response to public comments 
received during the comment period and to new data submitted by the 
technical registrant, Cheminova, Inc. Based on the new information 
received, and in a continuing effort to mitigate risk, the Agency has 
made certain modifications to the malathion RED.

EPA Impact Assessments on Endosulfan; Request for Comments and Additional Information on Importance of Use

SUMMARY: This notice requests public comment on the Agency's endosulfan impact assessments for eight crops (potato, tomato, cotton, apple, cucumber, squash, pumpkin and melons) and additional information on the importance of endosulfan use in agriculture.

Organic Arsenicals; Amendment to Reregistration Eligibility Decision

SUMMARY: This notice announces EPA's decision to modify certain provisions of the 2006 Reregistration Eligibility Decision (RED) for the organic arsenical pesticides monosodium methanearsonate (MSMA), disodium methanearsonate (DSMA), calcium acid methanearsonate (CAMA), and cacodylic acid and its sodium salt. EPA has reached an agreement in principle with the technical registrants of these pesticides to implement the 2006 RED, which is being revised in part under the terms of the agreement for these pesticides. The Agency's revisions to the organic arsenicals RED reflect public comments received during the comment period on the RED and new data and information submitted by the registrants and other stakeholders.

Clomazone and Fomesafen Registration Review Draft Ecological Risk Assessments; Notice of Availability

SUMMARY: This notice announces the availability of EPA's draft ecological risk assessments for the registration review of both clomazone and fomesafen and opens a public comment period on these documents. At the same time, EPA is initiating consultation for clomazone and fomesafen with the U.S. Fish and Wildlife Service and the National Marine Fisheries Service regarding potential effects to species listed as endangered or threatened under the Endangered Species Act. Registration review is EPA's periodic review of pesticide registrations to ensure that each pesticide continues to satisfy the statutory standard for registration, that is, the pesticide can perform its intended function without unreasonable adverse effects on human health or the environment. As part of the registration review process, the Agency has completed comprehensive draft ecological risk assessments, including endangered species effects determinations, for all clomazone and fomesafen uses. After reviewing comments received during the public comment period, EPA will issue final risk assessments, explain any changes from the draft risk assessments, and respond to comments. Once the ecological risk assessments have been finalized, the Agency will issue its proposed registration review decisions for these pesticides and seek public comment on any proposed risk mitigation. Through this program, EPA is ensuring that each pesticide's registration is based on current scientific and other knowledge, including its effects on human health and the environment.

Flumetralin Reregistration Eligibility Decision; Notice of Availability

SUMMARY: This notice announces the availability of EPA's Reregistration Eligibility Decision (RED) for the pesticide flumetralin, and opens a public comment period on this document. The Agency's risk assessments and other related documents also are available in the flumetralin Docket. Flumetralin is a plant growth regulator registered for use only on tobacco. It is used to control axillary bud (sucker) growth on tobacco plants. There are no food uses and there are no residential uses. EPA has reviewed flumetralin through the public participation process that the Agency uses to involve the public in developing pesticide reregistration and tolerance reassessment decisions. Through these programs, EPA is ensuring that all pesticides meet current health and safety standards.

Chromated Arsenicals, Pentachlorophenol, Creosote Reregistration Eligibility Decisions; Notice of Availability

SUMMARY: This notice announces the availability of EPA's Reregistration

Eligibility Decision (REDs) for the pesticides chromated arsenicals (e.g., CCA), pentachlorophenol, and creosote, collectively referred to as ``heavy duty wood preservatives.'' The Agency's risk assessments and other related documents also are available in the chromated arsenicals, pentachlorophenol, and creosote Dockets. The term heavy duty wood preservative is used to differentiate wood preservatives applied using specialized high pressure treatment cylinders (also called ``retorts'') from those applied using non-specialized methods (e.g., brush, dip). The three wood preservatives are used primarily for industrial purposes such as utility poles, pilings, and railroad ties. EPA has reviewed the heavy duty wood preservatives through the public participation process

that the Agency uses to involve the public in developing pesticide reregistration and tolerance reassessment decisions. Through these programs, EPA is ensuring that all pesticides meet current health and safety standards.

Acrolein, d-Phenothrin, and Sulfometuron Methyl, Reregistration Eligibility Decision; Notice of Availability

SUMMARY: This notice announces the availability of EPA's Reregistration Eligibility Decisions (REDs) for the pesticides acrolein, d-phenothrin, and sulfometuron methyl, and opens a public comment period on this document. The Agency's risk assessments and other related documents also are available in the acrolein, d-phenothrin, and sulfometuron methyl Dockets. Acrolein is a biocide used as a herbicide in irrigation canals and as an antimicrobial agent for drilling muds in the petroleum industry. d-Phenothrin is a synthetic pyrethroid with indoor uses in foggers, carpet powders, crack and crevice treatments, and pet care products and outdoor uses as a mosquito adulticide. Sulfometuron methyl is a non-selective sulfonylurea herbicide primarily used for weed control in forestry and vegetative management. Neither acrolein, d-phenothrin, or sulfometuron methyl have any food uses. EPA has reviewed acrolein, d-phenothrin, and sulfometuron methyl through the public participation process that the Agency uses to involve the public in developing pesticide reregistration and tolerance reassessment decisions. Through these programs, EPA is ensuring that all pesticides meet current health and safety standards.

Triclosan; Reregistration Eligibility Decision; Notice of Availability

SUMMARY: This notice announces the availability of EPA's Reregistration Eligibility Decision (RED) for the pesticide triclosan, and opens a public comment period on this document. The Agency's risk assessments and other related documents also are available in the triclosan Docket. Triclosan is regulated by both the U.S. EPA and the U.S. Food and Drug Administration (FDA). The EPA regulates the antimicrobial uses of triclosan when used as a bacteriostat, fungistat, mildewstat, and deodorizer. EPA has reviewed triclosan through the public participation process that the Agency uses to involve the public in developing pesticide reregistration and tolerance reassessment decisions. Carbaryl RED Amendment and Response to Petition to Cancel Registrations; Notice of Availability

SUMMARY: This notice announces the availability of an amendment to EPA's Reregistration Eligibility Decision (RED) for Carbaryl, and EPA's response to a petition from the Natural Resources Defense Council (NRDC), insofar as the petition seeks to have EPA cancel all registrations for carbaryl. In the carbaryl RED amendment, EPA is modifying certain worker risk mitigation measures that were imposed as a result of the 2004 Interim RED for the pesticide carbaryl. EPA is amending the carbaryl RED to incorporate the revised occupational exposure and risk assessment for carbaryl. EPA reevaluated the carbaryl risk assessments and regulatory decision in response to public comments received from numerous parties, new data submitted by the technical registrant, Bayer CropSciences, and new science and new methodologies developed in the time between the completion of the Interim RED for carbaryl and the completion of the cumulative risk assessment for the N-methyl carbamate group of pesticides. This notice also announces the availability of EPA's response to a petition from NRDC insofar as it seeks to have EPA cancel all uses of carbaryl under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Elsewhere in today's Federal Register, EPA is publishing its response to NRDC's petition insofar as it seeks to have EPA revoke all tolerances for carbaryl under the Federal Food, Drug, and Cosmetic Act (FFDCA).

Carbofuran; Notice of Availability of Revised Surface Water Exposure Assessment

SUMMARY: This notice announces the availability of EPA's revised surface water exposure assessment for the pesticide carbofuran. This revised assessment reflects the most current soil input parameters for the surface water exposure modeling done for the dietary risk assessment for carbofuran. While the underlying information based on soil type has been updated, the Agency's ultimate risk conclusions have not changed. The new drinking water exposure assessment dated August 20, 2008, entitled ``Updated Refinements of the Drinking Water Exposure Assessment for the Use of Carbofuran on Corn and Melons,'' is in the carbofuran docket.

Malathion; Order Amending Registration to Terminate Certain Uses

SUMMARY: EPA is granting a registrant's voluntary request for amendments to terminate certain uses of products containing the pesticide malathion, pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). This order follows a March 18, 1991 Federal Register Notice of Receipt of Requests to amend the registration of Fyfanon Technical, EPA Reg. No. 4787-5, to terminate certain uses. The requested amendments would not terminate all uses of malathion products registered for use in the United States. In the March 18, 1991 notice, EPA indicated that it intended to approve the requested amendments to terminate uses. Today's order does not terminate all of the uses identified in the March 18, 1991 notice, because Cheminova A/S and the Interregional Research Project No. 4 (IR-4) adequately supported certain uses. Accordingly, EPA hereby grants, in part, the requested registration amendments and orders the termination of the uses identified in Unit II. Any distribution, sale, or use of Fyfanon Technical, EPA Reg. No. 4787-5, is permitted only in accordance with the terms of this order, including any existing stocks provisions.

DATES: The uses of Fyfanon Technical, EPA Reg. No. 4787-5, described in Unit II of this cancellation order are cancelled effective August 27, 2008.

Metam Sodium, Metam Potassium and Chloropicrin; Notice of Receipt of Requests for Amendments to Delete Uses in Certain Pesticide Registrations

SUMMARY: In accordance with section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a notice of receipt of request for amendments by registrants to delete uses in certain pesticide registrations. Section 6(f)(1) of FIFRA provides that a registrant of a pesticide product may at any time request that any of its pesticide registrations be amended to delete one or more uses. Siduron Reregistration Eligibility Decision; Notice of Availability

SUMMARY: This notice announces the availability of EPA's Reregistration Eligibility Decision (RED) for the pesticide siduron, and opens a public comment period on this document. The Agency's risk assessments and other related documents also are available in the siduron Docket. Siduron is a selective, systemic preemergence herbicide used to control annual grassy weeds in stands of cool season grasses, such as on lawns, on golf courses, and on sod farms. SUMMARY: In accordance with section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a notice of receipt of request for amendments by registrants to delete uses in certain pesticide registrations. Section 6(f)(1) of FIFRA provides that a registrant of a pesticide product may at any time request that any of its pesticide registrations be amended to delete one or more uses. FIFRA further provides that, before acting on the request, EPA must publish a notice of receipt of any request in the Federal Register.

Pesticide Registration Review; New Dockets Opened for Review and Comment; Closure of the Phosalone Registration Review Case

SUMMARY: EPA has established registration review dockets for the pesticides listed in the table in Unit III.A. With this document, EPA is opening the public comment period for these registration reviews. The Agency is also announcing the closure of the phosalone registration review case (0027). Registration review is EPA's periodic review of pesticide registrations to ensure that each pesticide continues to satisfy the statutory standard for registration, that is, the pesticide can perform its intended function without unreasonable adverse effects on human health or the environment. Registration review dockets contain information that will assist the public in understanding the types of information and issues that the Agency may consider during the course of registration reviews. Through this program, EPA is ensuring that each pesticide's registration is based on current scientific and other knowledge, including its effects on human health and the environment.

The sole remaining nicotine registration, a restricted use insecticide registered for use only on greenhouse ornamentals and effective against adult whiteflies, aphids, and thrips, is being voluntarily cancelled by the registrant. Ethylene Oxide; Reregistration Eligibility Decision

SUMMARY: This notice announces the availability of EPA's Reregistration Eligibility Decision (RED) for the pesticide ethylene oxide (ETO). The Agency's risk assessments and other related documents also are available in the ETO Docket. ETO is used to sterilize medical or laboratory equipment, pharmaceuticals, and aseptic packaging, or to reduce microbial load on musical instruments, cosmetics, whole and ground spices or other seasoning materials and artifacts, archival material or library objects. Cypermethrin; Response to Comments and Amendment to Reregistration Eligibility Decision; Notice of Availability

SUMMARY: This notice announces EPA's intention to modify certain risk mitigation measures that were imposed as a result of the 2006 Reregistration Eligibility Decision (RED) for the pesticide cypermethrin. EPA conducted this reassessment of the cypermethrin RED in response to public comments directed towards product labeling, risk mitigation, and the upcoming registration review process for pyrethroids, pyrethrins, and synergist chemicals. In response to the commenters and continuing efforts to mitigate risk, the Agency has made several modifications to the cypermethrin RED label requirements for pre-construction termiticide applications, spray drift language for agricultural products, and ventilation for total release foggers.

Permethrin; Amended Reregistration Eligibility Decision; Notice of Availability

SUMMARY: This notice announces EPA's intention to modify certain risk mitigation measures that were imposed as a result of the 2006 Reregistration Eligibility Decision (RED) for the pesticide permethrin. EPA conducted this reassessment of the permethrin RED in response to public comments received. In response to the commentors and continuing efforts to mitigate risk, the Agency has made several modifications to the permethrin RED label requirements including: Clarification of application rates to mushroom houses; revised droplet sizes for wide area mosquito abatement products; and mandatory label statements for canine spot-on products, pre-construction termiticide applications, and spray drift language for agricultural products. Additionally, the Agency has revised the data requirements and added a statement to Section IV of the RED to address concerns regarding the residential use of outdoor pesticide misting systems.

Disulfoton; Amendment to and Clarification of Order to Amend Registration to Terminate Uses

SUMMARY: This notice announces EPA's amendment to and clarification of the order for the termination of uses, voluntarily requested by the registrant and accepted by the Agency, of products containing the pesticide disulfoton, pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. This amendment and clarification follows an October 10, 2007 Federal Register Notice of Order to Amend Registrations to Terminate Uses (72 FR 57571) of disulfoton (Di-Syston 15G) for multiple uses. The October 10, 2007 order and the December 15, 2004, Notice of Receipt of Request (69 FR 75061) that preceded the order were unclear as to whether the use of Di-Syston 15G on Fraser fir Christmas trees was terminated, except for use in the State of North Carolina. In addition, the registrant had withdrawn its request to terminate use of Di-Syston 15G on Christmas trees outside of North Carolina during the time allowed and EPA issued the order without having processed that withdrawal. Accordingly, EPA hereby is amending the order to clarify that use of disulfoton on Fraser fir Christmas trees is allowed nationwide.

Endosulfan Updated Risk Assessments; Notice of Availability, and Solicitation of Usage Information; Extension of Comment Period

SUMMARY: EPA issued a notice in the Federal Register of November 16, 2007 concerning the availability of EPA's updated human health and ecological effects risk assessments for the organochlorine pesticide endosulfan, based in part on data recently submitted by endosulfan registrants as required in the 2002 Reregistration Eligibility Decision (RED). The Agency is seeking comment on these updated assessments, as well as EPA's analysis of endosulfan usage information since the 2002 RED and its preliminary determinations regarding endosulfan's importance to growers and availability of alternatives. This document is extending the comment period from January 16, 2008, to February 19, 2008.

Dichlorvos (DDVP); Final Determination to Terminate Special Review

SUMMARY: On September 26, 2007, EPA issued in the Federal Register, a notice proposing to terminate the Special Review of dichlorvos (DDVP) because the risks that were the basis of the Special Review are no longer of concern. The Agency offered an opportunity to provide comment on the proposal. The Agency received no substantive comments in response to the proposal and EPA is announcing its final determination to terminate the Special Review of DDVP.

The Agency's risk assessments and other related documents also are available in the polypropylene glycol Docket. Butoxypolypropylene glycol (BPG) is the only active ingredient in the polypropylene glycol chemical case with any registered products. BPG is a repellant that is used to control flying and crawling insects. BPG was first registered for use in 1960, and can be applied to animals such as pets or horses directly, or to areas where animals live, like animal housing, bedding, or other areas animals may occupy. There are no food uses, and no uses on animals intended for slaughter. EPA has reviewed the polypropylene glycol chemical case through the public participation process that the Agency uses to involve the public in developing pesticide reregistration and tolerance reassessment decisions. Through these programs, EPA is ensuring that all pesticides meet current health and safety standards.

Siduron Risk Assessments; Notice of Availability, and Risk Reduction Options

SUMMARY: This notice announces the availability of EPA's risk assessments, and related documents for the pesticide siduron, and opens a public comment period on these documents. The public is encouraged to suggest risk management ideas or proposals to address the risks identified. EPA is developing a Reregistration Eligibility Decision (RED) for siduron through a modified, 4-Phase public participation process that the Agency uses to involve the public in developing pesticide reregistration decisions. This is Phase 3 of a 4-Phase process. Through this program, EPA is ensuring that all pesticides meet current health and safety standards.

Through this program, EPA is ensuring that each pesticide's registration is based on current scientific and other knowledge, including its effects on human health and the environment. This document also announces the Agency's intent not to open a registration review docket for dried blood. This pesticide is currently undergoing a voluntary cancellation process and is not, therefore, scheduled for review under the registration review program.

Notice of Hearing Concerning a Request to Reduce Pre-Harvest Interval for EBDC Fungicides on Potatoes; Amendment to Statement of Issues

SUMMARY: EPA is amending its July 11, 2007 Notice of Hearing (July Notice) document concerning a request to reduce the pre-harvest interval for the use of EBDC fungicides on potatoes. The July Notice set forth EPA's determination, the rationale for that determination, a description of the issues of fact and law to be adjudicated in the hearing, and a schedule for the hearing. EPA's determination in the July Notice that a hearing was appropriate was in response to the EBDC/ETU Task Force's (Task Force) petition requesting that the 1992 cancellation order be amended to allow for a 3-day pre-harvest interval (PHI) nationwide for use of EBDC pesticides on potatoes.

SUMMARY: This notice announces the availability of EPA's response to the petition dated June 2, 2006 submitted by the Natural Resources Defense Council (NRDC) insofar as the petition seeks to have EPA cancel all registrations for dichlorvos (DDVP). EPA's response is available in the DDVP docket (EPA-HQ-OPP-2002-0302) at http://www.regulations.gov.
