Petition to Revoke Tolerances for 13 Pesticides; Notice of Availability SUMMARY: EPA is announcing the availability and seeking comment on a July 23, 2009 petition from the American Bird Conservancy (ABC), requesting that EPA revoke tolerances established under the Federal Food, Drug and Cosmetic Act (FFDCA), section 408, for uses of 13 pesticides with no associated U.S. registrations. ABC claims that maintaining these tolerances allows Central and South American countries to continue using these pesticides on crops for which the United States has already determined there are unacceptable risks for U.S. protected migratory birds. DATES: Comments must be received on or before November 2, 2009.

Triclosan; Product Cancellation Order
SUMMARY: This notice announces EPA's order for the cancellations,
voluntarily requested by the registrant and accepted by the Agency, of
products containing the pesticide triclosan pursuant to section 6(f)(1)
of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as
amended. This cancellation order follows a April 22,2009 Federal
Register Notice of Receipt of Requests from the triclosan registrant to
voluntarily cancel all their triclosan technical grade product
registrations. These are not the last triclosan products registered for
use in the United States. In the April 22, 2009 notice, EPA indicated
that it would issue an order implementing the cancellations to
terminate uses, unless the Agency received substantive comments within
the 30-day comment period that would
merit its further review of these requests, or unless the registrant
withdrew their requests within this period. The Agency did not receive
any comments on the notice. Further, the registrant did not withdraw
their requests. Accordingly, EPA hereby issues in this notice a
cancellation order granting the requested cancellations. Any
distribution, sale, or use of the triclosan products subject to this
cancellation order is permitted only in accordance with the terms of
this order, including any existing stocks provisions.
DATES: The cancellations are effective July 30, 2009.

Notice of Receipt of Requests to Voluntarily Cancel Certain
Pesticide Registrations
SUMMARY: In accordance with section 6(f)(1) of the Federal Insecticide,
Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a
notice of receipt of request by registrants to voluntarily cancel
certain pesticide registrations.
DATES: Unless a request is withdrawn by January 19, 2010 or August 21,
2009 for registrations for which the registrant requested a waiver of
the 180-day comment period, orders will be issued canceling these
registrations. The Agency will consider withdrawal requests postmarked
no later than January 19, 2010 or August 21, 2009, whichever is
applicable. Comments must be received on or before January 19, 2010 or
August 21, 2009, for those registrations where the 180-day comment
period has been waived.

SUMMARY: In accordance with section 6(f)(1) of the Federal Insecticide,
Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a
notice of receipt of requests by registrants to voluntarily cancel
their registrations of products containing the pesticides disulfoton
and methamidophos. The requests would terminate the last disulfoton and
methamidophos products registered for use in the United States. EPA
intends to grant these requests at the close of the comment period for
this announcement unless the Agency receives substantive comments
within the comment period that would merit its further review of the
requests, or unless the registrants withdraw their requests within this
period. Upon acceptance of these requests, any sale, distribution, or
use of products listed in this notice will be permitted only if such
sale, distribution, or use is consistent with the terms as described in
the final order.
DATES: Comments must be received on or before August 21, 2009.

Pentachloronitrobenzene (PCNB); Amendments to Terminate Uses
SUMMARY: This notice announces EPA's order for the amendments to
terminate uses, voluntarily requested by the registrants and accepted
by the Agency, of certain products containing the pesticide PCNB,
pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and
Rodenticide Act (FIFRA), as amended. This order follows a March 30,
2009 Federal Register Notice of Receipt of Requests from the PCNB
registrants to amend voluntarily certain of their PCNB product
registrations. Specifically, the registrants requested to amend their
registrations to terminate the following uses of PCNB: Golf course
roughs; residential sites including lawns, yards, and ornamental plants
and gardens around homes and apartments; grounds around day care
facilities; school yards; parks (except industrial parks); playgrounds;
and athletic fields (except professional and college fields). In the
March 30, 2009 Notice, EPA indicated that it would issue an order
implementing the amendments to terminate uses, unless the Agency
received substantive comments within the 30-day comment period that
would merit its further review of these requests, or unless the
registrants withdrew their requests within this period. The Agency did
not receive any comments on the notice. Further, the registrants did
not withdraw their requests. Accordingly, EPA hereby issues in this
notice an order granting the requested amendments to terminate certain
uses. Any distribution, sale, or use of the PCNB products subject to
this order is permitted only in accordance with the terms of this
order, including any existing stocks provisions.
DATES: The cancellations are effective July 15, 2009.

Uses
SUMMARY: This notice announces EPA's order for the cancellations and
amendments to terminate uses, voluntarily requested by the registrants
and accepted by the Agency, of products containing the pesticide
malathion, pursuant to section 6(f)(1) of the Federal Insecticide,
Fungicide, and Rodenticide Act (FIFRA), as amended. This cancellation
order follows a May 20, 2009 Federal Register Notice of Receipt of
Requests from the malathion registrants to voluntarily cancel or to
amend to terminate uses of certain malathion product registrations.
These are not the last malathion products registered for use in the
United States. In the May 20, 2009 Notice, EPA indicated that it would
issue an order implementing the cancellations and amendments to
terminate uses, unless the Agency received substantive comments within
the 30 day comment period that would merit its further review of these
requests, or unless the registrants withdrew their requests within this
period. The Agency did not receive any comments on the notice. Further,
the registrants did not withdraw their requests. Accordingly, EPA
hereby issues in this notice a cancellation order granting the
requested cancellations and amendments to terminate uses. Any
distribution, sale, or use of the malathion products subject to this
cancellation order is permitted only in accordance with the terms of
this order, including any existing stocks provisions.
DATES: The cancellations are effective July 15, 2009.

Organic Arsenicals; Notice of Receipt of Requests to Voluntarily
Cancel or to Amend to Terminate Uses of Certain Pesticide Registrations
SUMMARY: In accordance with section 6(f)(1) of the Federal Insecticide,
Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a
notice of receipt of requests by the registrants to voluntarily cancel
and/or amend their registrations to terminate uses of certain products
containing the pesticide organic arsenicals. The organic arsenicals
include the pesticides monosodium methanearsonate (MSMA), disodium
methanearsonate (DSMA), calcium acid methanearsonate (CAMA), and
cacodylic acid and its sodium salt. The requests would terminate the
following uses of MSMA: Residential; forestry; non-bearing fruit and
nuts; citrus, bearing and non-bearing; bluegrass, fescue and ryegrass
grown for seed; drainage ditch banks; railroad, pipeline, and utility
rights of way; fence rows; storage yards; and similar non-crop areas.
In addition, the requests terminate all uses of MSMA in Florida except
for use on cotton grown in Calhoun, Columbia, Escambia, Gadsden,
Hamilton, Holmes, Jackson, Jefferson, Okaloosa, Santa Rosa, Suwannee,
Walton, and Washington counties. The requests would not terminate the
last MSMA products registered for use in the United States. These
requests for voluntary cancellation and amendment of MSMA containing
products are the result of an agreement in principle signed by the EPA
and the technical registrants of the organic arsenicals on January 16
and February 5, 2009. As part of the agreement, the registrants have
requested voluntary cancellation of all products containing DSMA, CAMA,
and cacodylic acid and its sodium salt. The requests would terminate
the last DSMA, CAMA, and cacodylic acid and its sodium salt products
registered for use in the United States. EPA intends to grant these
requests at the close of the comment period for this announcement
unless the Agency receives substantive comments within the comment
period that would merit its further review of the requests, or unless
the registrants withdraw their requests within this period. Upon
acceptance of these requests, any sale, distribution, or use of
products listed in this notice will be permitted only if such sale,
distribution, or use is consistent with the terms as described in the
final order.
DATES: Comments must be received on or before August 7, 2009.

Sodium Dimethyldithiocarbamate; Notice of Receipt of Requests for
Amendments to Delete Uses in a Pesticide Registration
SUMMARY: In accordance with section 6(f)(1) of the Federal Insecticide,
Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a
notice of receipt of request for amendments by registrants to delete
uses in a pesticide registration. Section 6(f)(1) of FIFRA provides
that a registrant of a pesticide product may at any time request that
any of its pesticide registrations be amended to delete one or more
uses. FIFRA further provides that, before acting on the request, EPA
must publish a notice of receipt of any request in the Federal
Register.
DATES: The deletions are effective July 31, 2009, unless the Agency
receives a written withdrawal request on or before July 31, 2009. The
Agency will consider a withdrawal request postmarked no later than July
31, 2009.
Users of this product who desire continued use on crops or sites
being deleted should contact the applicable registrant on or before
July 31, 2009.

Petition Requesting Cancellation of all Tetrachlorvinphos Pet
Uses and Extension of Comment Period for Petition Requesting
Cancellation of Propoxur Pet Collar Uses; Notice of Availability
SUMMARY: On April 24, 2009, the Agency received a petition from the Natural Resources Defense Council (NRDC) to cancel all pet uses for the pesticide tetrachlorvinphos (TCVP) and a supplement to a previous NRDC petition to cancel all pet collar uses for the pesticide propoxur. NRDC requested these cancellations based on their belief that EPA failed to adequately assess residential exposures to TCVP and propoxur pet collars. NRDC believes that EPA used incorrect exposure assumptions leading to underestimation of residential risk in the TCVP Reregistration Eligibility Decision (RED), Propoxur RED, and N-methyl Carbamate (NMC) Cumulative Risk Assessment (CRA). On April 8, 2009, the Agency opened a 60-day public comment period for the petition to cancel propoxur pet collar uses, originally scheduled to close June 8, 2009. This notice extends the comment period on the propoxur petition to correspond with the timing of the TCVP comment period.
DATES: Comments must be received on or before August 4, 2009.

Nicotine; Product Cancellation Order
SUMMARY: This notice announces EPA's order for the cancellation, voluntarily requested by the registrant and accepted by the Agency, of products containing the pesticide nicotine, pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. This cancellation order follows an October 29, 2008 Federal Register Notice of Receipt of Request from the nicotine registrant to voluntarily cancel its sole remaining nicotine product registration. This product registration is the last nicotine pesticide product registered for use in the United States. In the October 29, 2008 Notice, EPA indicated that it would issue an order implementing the cancellation, unless the Agency received substantive comments within the 180- day comment period that would merit its further review of these requests, or unless the registrant withdrew its request within this period. The Agency did not receive any comments on the notice. Further, the registrant did not withdraw its request. Accordingly, EPA hereby issues in this notice a cancellation order granting the requested cancellation. Any distribution, sale, or use of the nicotine product subject to this cancellation order is permitted only in accordance with the terms of this order, including any existing stocks provisions.
DATES: The cancellation is effective January 1, 2014.

Malathion; Notice of Receipt of Requests To Voluntarily Cancel or To Amend To Terminate Uses of Certain Pesticide Registrations
SUMMARY: In accordance with section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a notice of receipt of requests by the registrants to voluntarily cancel or amend their registrations to terminate uses of certain products containing the pesticide malathion. The requests would terminate the malathion uses listed with their respective products in Table 2. The requests would not terminate the last malathion products registered for use in the United States. EPA intends to grant these requests at the close of the comment period for this announcement unless the Agency receives substantive comments within the comment period that would merit its further review of the requests, or unless the registrants withdraw their requests within this period. Upon acceptance of these requests, any sale, distribution, or use of products listed in this notice will be permitted only if such sale, distribution, or use is consistent with the terms as described in the final order.
DATES: Comments must be received on or before June 19, 2009.

Amendments to Terminate Certain Pesticide Uses
SUMMARY: This notice announces EPA's order for the amendments to terminate certain uses, voluntarily requested by the registrants and accepted by the Agency, of certain pesticide products, pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. This cancellation order follows an October 8, 2008, Federal Register Notice of Receipt of Requests from registrants to voluntarily amend their registrations of certain pesticide products (73 FR 58958; FRL-8385-2). In the October 8, 2008, Notice, EPA indicated that it would issue an order implementing the cancellation and amendments to terminate certain uses, unless the Agency received substantive comments within the 30 day comment period that would merit its further review of these requests, or unless the registrants withdrew their requests within this period. The Agency did not receive any comments on the notice except for comments pertaining to aldicarb. Accordingly, EPA hereby issues in this notice a cancellation order granting the requested amendments to terminate certain pesticide product uses except for the uses of aldicarb on coffee, pecans, and tobacco. The product cancellation order for the chloroneb product, Demosan 65W (EPA Reg. No. 073782-00002), which was included in the October 8, 2008 notice will be included in a separate Federal Register notice. Any distribution, sale, or use of the products subject to this cancellation order is permitted only in accordance with the terms of this order, including any existing stocks provisions.
DATES: The cancellations are effective May 20, 2009.

Petition Requesting Cancellation of Propoxur Pet Collar Uses; Notice of Availability
SUMMARY: EPA is seeking public comment on a November 26, 2007 petition from the Natural Resources Defense Council (NRDC), requesting that the Agency cancel propoxur pet collar uses. The petitioner, NRDC, requests this action because they believe that modifications to the non-dietary oral exposure pathway presented in the Revised N-methyl Carbamate (NMC) Cumulative Risk Assessment (CRA) underestimate exposure to propoxur from pet collar uses.
DATES: Comments must be received on or before June 8, 2009.

Pentachloronitrobenzene (PCNB); Notice of Receipt of Requests to Amend Registrations to Terminate Uses of Certain
Pesticide Registrations
SUMMARY: In accordance with section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a notice of receipt of requests by the registrants to voluntarily amend their registrations to terminate uses of certain products containing the pesticide pentachloronitrobenzene, or PCNB. The requests would terminate PCNB use on golf course roughs (i.e., use on golf courses will be limited to tees, greens, and fairways); residential sites including lawns, yards, and ornamental plants and gardens around homes and apartments; grounds around day care facilities; school yards; parks (except industrial parks); playgrounds; and athletic fields (except professional and college fields). The requests would not terminate the last PCNB products registered for use in the United States.
DATES: Comments must be received on or before April 29, 2009.

Fomesafen; Product Cancellation Order
SUMMARY: This notice announces EPA's order for the cancellation, voluntarily requested by the registrant and accepted by the Agency, of products containing the pesticide fomesafen, pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. This cancellation order follows a December 31, 2008 Federal Register Notice of Receipt of Request from the fomesafen registrant to voluntarily cancel all their fomesafen product registrations. Fomesafen is a pre-plant, pre-emergence and post-emergence herbicide used on soybeans, snap beans, dry beans, and cotton. It is also registered for use on agricultural fallow/idleland, nonagricultural uncultivated areas/soils, pine (forest/shelterbelt) and pine (seed orchard). These are not the last fomesafen products registered for use in the United States. In the December 31, 2008 Notice, EPA indicated that it would issue an order implementing the cancellations, unless the Agency received substantive comments within the 30-day comment period that would merit its further review of these requests, or unless the registrant withdrew their request within this period. The Agency did not receive any comments on the notice. Further, the registrant did not withdraw their request. Accordingly, EPA hereby issues in this notice a cancellation order granting the requested cancellations. Any distribution, sale, or use of the fomesafen products subject to this cancellation order is permitted only in accordance with the terms of this order, including any existing stocks provisions.
DATES: The cancellations are effective March 25, 2009.

Carbofuran; Product Cancellation Order
SUMMARY: This notice announces EPA's order for the cancellation of some registrations and termination of certain uses, voluntarily requested by the registrant and accepted by the Agency, of products containing the pesticide carbofuran, pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. This cancellation order follows a December 19, 2008 (73 FR 77690; FRL-8389-4) Federal Register Notice of Receipt of Request from the carbofuran registrant to voluntarily cancel some registrations and terminate uses of certain end-use products containing the pesticide carbofuran. These are not the last carbofuran products registered for use in the United States. In the December 19, 2008 notice, EPA indicated that it would issue an order implementing the cancellations and amendments to terminate uses, unless the Agency received substantive comments within the 30-day comment period that would merit its further review of these requests, or unless the registrant withdrew their request within this period. The Agency received two anonymous comments on the notice, but neither merited further review of the requests. Further, the registrant did not withdraw their request, but submitted a letter clarifying the product registrations that they intended to cancel. Accordingly, EPA hereby issues in this notice a cancellation order granting the requested cancellations and use terminations. Any distribution, sale, or use of the carbofuran products subject to this cancellation order is permitted only in accordance with the terms of this order, including any existing stocks provisions.
DATES: The cancellations are effective March 18, 2009.

Carbaryl; Amending Product Registrations to Terminate Uses and Eliminate Certain Application Methods
SUMMARY: This notice announces EPA's order for the amendments to terminate uses and eliminate certain application methods, voluntarily requested by the registrants and accepted by the Agency, of products containing the pesticide carbaryl, pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. This order follows two Federal Register Notices of Receipt of Requests dated August 20, 2008 and October 15, 2008, respectively, from the carbaryl registrants to voluntarily terminate certain uses of and eliminate certain application methods for their carbaryl product registrations. These are not the last carbaryl products registered for use in the United States. In the August 20 and October 15, 2008 Notices, EPA indicated that it would issue an order implementing the amendments to terminate uses, unless the Agency received substantive comments within the 30-day comment period that would merit its further review of these requests, or unless the registrants withdrew their requests within this period. The Agency received five comments on the notice but none merited further review of the requests. Further, the registrants did not withdraw their requests. Accordingly, EPA hereby issues in this notice an order granting the requested amendments to terminate uses and eliminate certain application methods. Any distribution, sale, or use of the carbaryl products subject to this order is permitted only in accordance with the terms of this order, including any existing stocks provisions.
DATES: The termination of uses and elimination of application methods for carbaryl products specified in this notice are effective April 17, 2009.

Carbofuran; Notice of Receipt of Request to Voluntarily Cancel Carbofuran Pesticide Registrations
SUMMARY: In accordance with section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a notice of receipt of a request dated September 29, 2008 by the registrant to voluntarily cancel some registrations and amend other registrations to terminate uses of certain end-use products containing the pesticide carbofuran. The request would terminate flowable carbofuran use in or on alfalfa, cotton, ornamentals, popcorn, small grains (wheat, oats and barley) soybeans, sugarcane, sweet corn, and tobacco. The request would also terminate all carbofuran products registered under FIFRA section 24 Special Local Need Labels for use in or on corn (field), CRP acres, cucumbers, grapes, melons, ornamentals (container and field production), peppers (including Chiles and bell), sorghum, squash, sugar beets, sugarcane (soil applied), tobacco, and small grains (wheat, oats, and barley). The request would also terminate, subject to a two-year phase-out period, the use of flowable carbofuran as a post-plant application to artichokes. The request proposes to cancel the use of granular carbofuran on bananas, coffee, cucumbers, melons, and squash. The request would not terminate the last carbofuran products registered for use in the US.

SUMMARY: This notice announces EPA's amendment to the order for the cancellation of products, voluntarily requested by the registrant and accepted by the Agency, of products containing the pesticide fenamiphos, pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. This amendment follows a June 11, 2008 Federal Register Amendment to Use Deletion and Product Cancellation Order which extended the deadline for persons other than the registrant to sell and distribute two fenamiphos products, Nemacur 10% Turf and Ornamental Nematicide (EPA Reg. No. 432-1291) and Nemacur 3 Emulsifiable Systemic Insecticide-Nematicide (EPA Reg. No. 264-731), from May 31, 2008, until November 30, 2008. These are the last fenamiphos products registered for use in the United States. The Agency subsequently received a request from an end user to extend the sale and distribution deadline for Nemacur 3. The Agency will extend the deadline for persons other than the registrant to sell and distribute Nemacur 3 Emulsifiable Systemic Insecticide-Nematicide (EPA Reg. No. 264-731) until March 31, 2009.
DATES: This amendment is effective December 10, 2008.
